THE LAW:-

S.90 of Evidence Act 1950 relates to the presumption of due execution and handwriting on a document which is 20 years or more . It applies to both public and private documents.

The presumption goes only to the genuineness of the document but not to the truth of the contents.

Augustine Paul, Evidence Practice and Procedure, 3rd Edition, 2003, at page 672


CASE:-

Per Sharma J in Commissioners of the Municipality of Malacca v. Sinniah [1974] 1 MLJ 77, 79

“Private or public documents twenty years old produced from proper custody and otherwise free from suspicion prove themselves and no evidence of the handwriting, signature, sealing or delivery need in general be given. If a document twenty years old or more is produced from proper custody and is on its face free from suspicion the Court may presume:

(1) that it has been signed or written by the person whose signature appears or in whose handwriting it purports to be; and
(2)that it has been fully attested and executed if it purports to be so.
